Terms & Conditions
1. Acceptance of the Agreement
By accessing and using this website and services, you agree to these Terms & Conditions, which constitute a binding agreement between you and The High Club (ABN: 27 124 753 694). These terms are legally binding. By continuing to use our services, you are accepting these terms.
Your statutory rights under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010) are not affected, limited, or excluded by anything in these Terms & Conditions.
Responsibility
You are responsible for staying informed about any updates or changes to these Terms & Conditions. We will take reasonable steps to notify you of material changes, including by posting notice on our website. Your continued use of our services following any such update implies acceptance of the revised terms.
1. Services
The High Club offers the following services:
- Create, design, and customise products listed for sale
- Buy products listed for sale, choosing custom made products
- Save and share designs
- Save created images and designs into public and personal galleries
- Post created images to social networks or blogs (with legal permission)
- Register to subscribe to special offers and use of galleries
1.1 Refund, Replacement & Return Policy
Your Rights Under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Nothing in our Terms and Conditions or Returns Policy limits or excludes these statutory guarantees.
Refund Method
Where a refund is approved by The High Club, the refund will only be processed back to the original payment method used to place the order.
Refunds cannot be:
- Redirected to an alternative bank account or payment method
- Converted to cash payments unless otherwise required by law
Refund processing timeframes may vary depending on the original payment provider or financial institution.
Refunds will only be processed once the garments have been returned to and received by The High Club's agent warehouse, unless otherwise agreed in writing.
Commitment to Quality
We are dedicated to delivering high-quality prints and strive for excellence in every product we produce. If you are dissatisfied with your purchase, please review the instructions below.
Change of Mind Returns
As these are custom made products, we do not offer refunds, returns or replacements for change of mind or wrong size and colour. Please choose carefully before placing your order and check the selected order is correct.
Faulty, Damaged, or Incorrectly Printed Items
If your item is faulty, damaged upon arrival, has a print error that is our fault, or was delivered in a different size or colour to the order placed, you are entitled to a remedy under the ACL. Please contact us within 14 days of receiving your order.
How to initiate a Return, Refund or Replacement
To initiate a return, please email The High Club at info@thehighclub.com.au requesting an RMA (Return Merchandise Authorisation) and provide the following information so we can arrange:
- Your first and last name
- Order number
- Date of purchase
- Which garment(s) you wish to return
- A brief description of the fault or print error
- Photographs of the garment
- Quantity of products affected
- Advise if you would prefer a refund or replacement
Our team will review your RMA request and contact you to discuss available options. Please note that failure to provide sufficient information as requested above may delay or void the claim assessment.
What Cannot Be Returned, Refunded or Replaced (Change of Mind)
Returns, refunds or replacements are not provided for:
- Change of mind
- Incorrect garment size or colour selections made by the customer - it is your responsibility to check the sizing and colour. Each product will state the size of the garment.
- Colour variations between screen display and printed product
- Minor print placement variations within industry tolerances
- Customer dissatisfaction with garment style, fit, fabric preference, or product expectations
- Shipping carrier, courier or delivery delays beyond our control
- Supplier stock delays or substitutions
- Incorrect shipping addresses provided at checkout
- Incorrect size ordered by customer
Please note: Sizing measurements may vary by +/- 2.5cm; deviations beyond this tolerance are considered faulty. Print dimensions and placement are accurate within +/- 2–3cm; exceeding this is considered faulty.
Shipping Costs for Returns
Where a return is due to a fault on our part, we will cover or reimburse reasonable return shipping costs in accordance with ACL obligations. Where a return is not due to our fault, the customer is responsible for return shipping fees.
For returns due to faulty goods, delivery fees paid will be assessed on a case-by-case basis in accordance with the ACL. Refunds will be issued to the original payment method.
Important Notes
- All garments must be returned to The High Club before a replacement or refund is issued.
- Customers must return garments within 14 days of The High Club approving the RMA request.
- Products must be returned in original condition and products must not be worn, washed, or altered.
- The High Club reserves the right to reject returned items that do not meet return conditions.
Processing Time
The High Club may require up to ten (10) business days to assess and process any claim after all required information has been received.
Replacement production lead times commence only after claim approval and receipt of returned garments where applicable.
Approved refunds will be processed to the original payment method only and may take additional time to appear depending on the payment provider. The High Club will require up to 10 working days to process your refund once the RMA and ordered products are returned to our agents warehouse.
1.2 Cancellation Policy
All online orders are placed into our production schedule promptly upon submission. Due to the nature of our custom production process, we are generally unable to accommodate changes or cancellations once an order has been submitted.
Please review your order carefully before submitting.
If exceptional circumstances arise, please contact us as soon as possible at info@thehighclub.com.au and we will assess your request on a case-by-case basis. Nothing in this clause limits your rights under the ACL where The High Club is unable to fulfil your order.
1.3 Production Timeframes
Standard Production
As our garments are made specifically for each order, it will take approximately 14 business days to be printed and delivered within Australia. Orders may be dispatched earlier where possible. Orders for outside of Australia are currently not being processed.
1.4 Delivery Timeframes
We take great pride in meeting our production and printing timeframes. However, some circumstances are beyond our control, including freight carrier delays. In the event of a delay caused by the freight carrier, we cannot be held responsible for that delay, though we will assist where possible.
Where a delay is caused by supplier stock availability, we will still process and dispatch your order as quickly as possible. Stock or shipping delays do not entitle you to a refund unless The High Club is unable to fulfil the order at all, in which case your ACL rights apply.
1.5 Lost / Damaged Parcels
Once your order has been dispatched with a freight carrier, The High Club cannot be held liable for loss or damage occurring while in transit, unless it arises from our own negligence. The freight carrier is an independent contractor with their own processes and procedures and is not required to notify you before delivery.
The High Club accepts no responsibility for missing goods where the recipient has an Authority to Leave (ATL) arrangement in place and the carrier's records confirm delivery.
Any courier claims must be lodged to info@thehighclub.com.au so we can then investigate
with the shipping provider where applicable.
Investigating Delays
If your order has not arrived within the expected timeframe:
- Contact the freight carrier directly and lodge an enquiry via their website
- Notify us so we can also lodge an enquiry on your behalf
Please be aware that freight carriers may take up to 4+ weeks to investigate, and this process is outside our control.
Replacement or Refund
We can only arrange a replacement or refund for an order that the freight carrier formally deems "lost." Most freight carriers maintain records for a maximum of 30 days. It is the customer's responsibility to contact the carrier if their parcel has not been delivered within this period.
1.6 Stock Availability
We offer a wide range of garment options, but occasionally our suppliers may experience stock shortages. If an item in your order is out of stock, we will notify you promptly via email and present options for how to proceed. The High Club cannot be held responsible for supplier stock shortages, but we will work with you to find a solution.
1.7 Washing Instructions
To maintain the quality of your garment and its prints, please follow the garment label and these care instructions:
- Wash on a cold, gentle cycle
- Wash inside out
- Do not tumble dry
- Dry in shade, away from direct sunlight
- If ironing is necessary, iron inside out
- Avoid harsh chemicals
Following these instructions will help prevent shrinkage and prolong the life of your garment. The durability of prints is ultimately affected by your care and maintenance.
1.8 Shipping & Delivery

Standard Processing: As our products are custom orders, these are typically processed and shipped within 14 business days (excluding weekends and holidays).
- Standard Shipping Australia: AUD $10 flat rate (please allow 14 business days from date of purchase).
- Expedited Shipping: Apologies but we do not offer expediated shipping yet.
- Free Shipping: Apologies but we do not offer free shipping yet.
- International Shipping: Apologies but we do not offer international shipping yet.
- In-Store Pickup: As we do not yet have a shopfront we don't offer in-store pickup.
- Once your order ships, you will receive a shipment confirmation email with a tracking number.
2. Using Our Website & Eligibility
The High Club will only knowingly provide products or services to persons who can lawfully enter into contracts under applicable law.
If you are under the age of 18 you may not view or order products from this website.
2.2 Definitions and Interpretation
In these Terms & Conditions, unless context indicates otherwise:
- Intellectual Property Rights means all industrial, commercial, and intellectual property rights (including equivalent or proximate rights anywhere in the world that currently exist or are recognised in the future).
- Person means any form of legal entity or quasi-legal entity.
- User means any person using the website and/or services provided by The High Club.
- A reference to any document, material, or data includes that document, material, or data however stored or recorded, including in any electronic or digital media.
- The word "includes" is not a word of limitation.
3. User Obligations
3.1 Responsibilities
Users are solely and exclusively responsible, at their own cost, for:
- All telecommunications lines, hardware, and software necessary to access and use the Website and services
- Their use of the Website, including any content they create or upload
- Complying with all applicable laws, regulations, and rules in their jurisdiction
- Complying with any guidelines issued by The High Club in relation to the Website and services
- Ensuring all electronic media used in connection with the Website complies with these Terms & Conditions and applicable law
3.2 Restrictions on Users
Users must not:
- Reproduce, publish, distribute, sub-licence, or resell the Website, designs or services
- Modify, adapt, disassemble, or reverse engineer the Website or services
- Use the Website to create or distribute content that infringes the Intellectual Property Rights, privacy, or other legal rights of any person
- Create or distribute content that is defamatory, libellous, or slanderous
- Introduce any virus, malware, or disruptive technology to the Website
- Use robots, spiders, or automated devices to monitor or copy pages from the Website
- Impersonate another person or entity
- Interfere with other users' ability to access the Website
- Use spam or unsolicited messages to market products or services
The High Club reserves the right to terminate access, disable accounts, and take legal action against any user who breaches these Terms & Conditions or applicable law, at its sole discretion and without prior notice.
4. The High Club Obligations
4.1 Access to and Use of the Website and Services
Subject to the user complying with these Terms & Conditions, The High Club will allow access to and use of the Website and services.
4.2 Privacy
The High Club may collect personal data in the course of a user's use of the Website and services. The High Club will comply with its Privacy Policy and applicable Australian privacy law. The Privacy Policy can be accessed via the link on the Website.
4.3 Training
The High Club has no obligation to provide training or support in relation to use of the Website or services.
4.4 Modification of the Website
The High Club reserves the right to modify, suspend, or discontinue any aspect of the Website or services at any time. Where reasonably practicable, notice will be provided. The High Club shall not be liable for any modification, suspension, or discontinuation of the Website or services.
5. Intellectual Property Rights
5.1 Reservation of Title
These Terms & Conditions do not convey any Intellectual Property Rights in the Website or services to the user, other than the limited licence granted below. The High Club grants users a limited, revocable, non-exclusive licence to access and use the Website for its intended purposes, subject to compliance with these Terms & Conditions.
5.2 Prohibition on Infringement
Users must not access or use the Website in a manner that infringes, or is likely to infringe, the Intellectual Property Rights or other rights of any person.
5.3 User-Created Content
Users own the Intellectual Property Rights in any original material they create using the Website's functionality. If a user adds content to a public gallery, they grant The High Club an irrevocable, perpetual, non-exclusive, worldwide licence to use that content in connection with the Website and services.
6. Registration
Upon completing registration, you will receive an account and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify The High Club immediately of any unauthorised use of your account or any security breach. The High Club is not liable for any loss or damage arising from your failure to maintain account security.
7. Warranties
7.1 User Warranties
Users represent and warrant that their use of the Website and services will not infringe the Intellectual Property Rights, privacy, or other legal rights of any person, and that they will comply with all applicable laws.
7.2 The High Club's Warranties
The High Club warrants that it has the right to grant access to and licence the use of the Website and services to users in accordance with these Terms & Conditions.
7.3 Caveats
The Website and services are provided on an "as is" and "as available" basis. The High Club does not warrant that the Website will be uninterrupted, error-free, or meet individual user requirements.
7.4 Exclusion of Implied Warranties
To the maximum extent permitted by law, all implied conditions, warranties, and representations relating to the Website or services are excluded, except where such exclusion is prohibited by the ACL or other applicable law.
7.5 No Representation or Reliance
Users acknowledge that they do not enter into these Terms & Conditions in reliance on any representation by The High Club, except as expressly set out herein.
8. Exclusion and Limitation of Liability
8.1 ACL Rights Preserved
Nothing in these Terms & Conditions excludes, restricts, or modifies any right or remedy the user may have under the ACL or any other applicable law that cannot be excluded, restricted, or modified by agreement.
8.2 Exclusion of Liability
Subject to clause 8.1, The High Club is not liable for:
- Malfunctions caused by third parties, user misuse, force majeure, or events outside The High Club's reasonable control
- Any loss of profit, business interruption, loss of goodwill, or indirect, consequential, or punitive damages of any nature
8.3 Third Party Links
The High Club may include links to third-party websites. The High Club is not responsible for the content, accuracy, or operation of those websites and users access them at their own risk.
8.4 Limitation of Liability
Subject to clause 8.1, The High Club's total liability to a user for any breach of these Terms & Conditions is limited to the substitution or replacement of any product or service ordered and paid for by the user.
8.5 Indemnity
Users agree to indemnify The High Club against any liability, loss, cost, or expense arising from their use of the Website or services, any breach of these Terms & Conditions, or any infringement of third-party rights.
9. Termination
9.1 Termination by The High Club
The High Club may immediately terminate a user's access to the Website and services at any time, with or without cause, including where a user breaches these Terms & Conditions. Termination does not relieve the user of obligations accrued prior to termination.
9.2 Termination by User
A user may terminate their use of the Website at any time by ceasing to access it.
9.3 Effect of Termination
Upon termination, The High Club may delete content or material relating to the user's account. The termination of these Terms & Conditions does not affect any accrued rights or remedies of either party.
10. General
10.1 Severability
If any clause or part of a clause of these Terms & Conditions is found to be void, invalid, or unenforceable, it will be severed to the minimum extent necessary, without affecting the validity of the remaining terms.
10.2 Variation
The High Club may amend these Terms & Conditions from time to time. We will take reasonable steps to notify users of material changes by posting notice on the Website. Your continued use of the Website following the posting of amended terms constitutes acceptance of those changes. If you do not agree to any amendment, you should cease using the Website and services.
10.3 Waiver
A waiver by either party is only effective if given in writing and signed by the waiving party.
10.4 Assignment
The High Club may transfer, assign, or novate any of its rights or obligations under these Terms & Conditions on giving the user no less than five (5) days' written notice.
10.5 Governing Law
These Terms & Conditions are governed by the laws of Australia. The parties submit to the non-exclusive jurisdiction of the courts of the relevant state or territory.
